WASHINGTON — The U.S. Supreme Court will allow Kansas to sue Nebraska for taking too much water from the Republican River basin. Kansas Attorney General Derek Schmidt says that the court agreed to let the state reopen its lawsuit against Nebraska, who said violated a 20-year-old agreement over how much Nebraska and Colorado could take from the Republican River. The federal government supports Kansas and has expressed concern about the effects of Nebraska’s groundwater pumping on the federal water projects in the Republican basin, he said. The high court appointed William Kayatta, Jr., of Maine, as special master to hear evidence and to make recommendations to the court.
