OTTAWA–The first degree murder trial of John Balbirnie appears to be moving into its final phase. The state has rested its case, and the defense is set to present its case. After that the case will go to the jury. Judge Thomas Sachse…in reviewing possible jury instructions…said he may consider allowing the jury to consider lesser charges and even the element of self-defense, given the testified aggressiveness of the victim, Paul Nicholson. The judge is expected to rule on those issues before the case goes to the jury.
