WASHINGTON — A federal appeals panel has over-turned the U.S. environmental protection agency’s cross-state air pollution rule. On a split 2-1 vote Tuesday, a panel of the U.S. Court of Appeals for the District of Columbia ruled that the EPA exceeded its authority by imposing a new emissions rule on coal-fired power plants in the Midwest. The panel blocked the new rule until the EPA rewrites it or appeals it. The Midwestern utilities, business groups and most Kansas Republican officials hailed the ruling, calling the new air-quality regulation costly, arbitrary and burdensome. Environmental groups and the American Lung Association say the EPA rule would have improved the health of 240 million Americans downwind from the power plants. The rule was published by EPA in the summer of 2011.
