TOPEKA — Kansas Attorney General Derek Schmidt has asked the U.S.. Supreme Court to block a new EPA regulations affecting stationary-source businesses and industries that generate greenhouse gases. Texas and 11 other states have challenged the EPA greenhouse gas regulation for four years. The U.S. Court of Appeals for the District of Columbia circuit upheld the EPA but the Supreme Court decided to hear the appeal. Now that the case has reached the high court, Schmidt has filed a brief on behalf of Kansas and five other states in support of Texas. Schmidt said the Kansas economy relies heavily on both the production and use of fossil fuels, and the restrictions would be expensive for Kansans. The state is also involved in two other air-quality lawsuits against the EPA.
