OTTAWA – Despite objections from Kyle Flack’s attorney, District Judge Thomas Sachse ruled Friday that certain DNA testing can continue. Defense attorney Ron Evans said the testing will destroy some of the evidence, which would prevent him and his client from inspecting the DNA evidence if it is destroyed during the testing. Such testing would violate Flack’s constitutional right to confront the witnesses and evidence against him, Evans said – a contention rejected by the judge. Flack is charged in the quadruple murder of Kaylie and Lana Bailey, Andrew Stout, and Steven White near Richter earlier this year. Fack will be back the courtroom on Jan. 16 for a status hearing.
