OTTAWA — Prosecutors formally declared this morning that they will seek the death penalty against Kyle Flack in connection with the multiple murders near Rchter last year. Because Flack refused to make a plea in a hearing in Franklin County District Court this morning, District Judge Eric Godderz issued a not guilty plea on Flack’s behalf. If Flack is convicted with the murders of Kaylie and Lana-Leigh Bailey, Franklin County Attorney Stephen Hunting said he will seek the death penalty. If Flack is convicted in the killings of Andrew Stout and Steven White, Hunting will seek a Hard-50 sentence. However, that is still at least a year and a half away. Flack’s trial was tentatively set to begin in September 2015. Flack’s next hearing will be June 6.
