KANSAS CITY, Kan. – U.S. District Judge Daniel Crabtree will hear arguments Friday over whether he should order kansas to allow same-sex marriages. Voters approved a constitutional amendment 10 years ago that bans same-sex marriages and domestic civil unions. However, the American Civil Liberties Union seeks a temporary injunction against that constitutional ban and seeks to bring Kansas into line with a 10th circuit federal court of appeals ruling that applies to other states in the 10th circuit. When those states appealed, the U.S. Supreme Court refused to intervene, which requires those states to follow the appeals court order to end their bans against same-sex marriages. Gov. Sam Brownback and Attorney General Derek Schmidt say they’ll defend the state’s ban.
