OTTAWA — District Judge Eric Godderz has rejected another request by attorneys for Kyle Flack to move his murder trial out of Franklin County.  Flack faces capital murder charges in connection with the murders of Kaylie Bailey and her toddler daughter,  Lana Leigh Gailey, and murder charges in connection with the murders of Andrew Stout and Steven White at a farmhouse north of Richter two years ago.  Flack’s attorney Timothy Frieden offered filings that indicate two studies that show that knowledge of the murders is pervasive, even in other areas of the Kansas City area and that finding an unbiased jury would be difficult.  Franklin County Attorney Stephen Hunting objected to the request, saying although many people were aware of the case, the studies don’t show that those people couldn’t be objective.  He said there was no evidence that the court couldn’t come up with an unbiased jury.  At a court hearing Tuesday for Flack, Godderz said that although the multiple murders have been widely publicized, the publicity doesn’t appear to be an obstacle to a fair trial for Flack.  Godderz said he could reconsider Fieden’s motion depending on the outcome of impaneling a jury.  The next hearing for Flack was set for Oct. 28.
