OTTAWA — After three hours of deliberation this afternoon, a Franklin County jury convicted Kyle Flack of capital murder for the shot-gun deaths of Kaylee and her 18-month-old daughter, Lana Bailey, first-degree murder for the death of Steven White, and  second-degree murder for the death of Andrew Stout.  The jury also found Flack guilty of criminal possession of a firearm.  A second hearing on whether Flack will receive the death penalty begins Monday. At the request of Flack’s attorneys, jurors will face a second round of “voire dire” questioning Thursday morning to see if they have already made up their minds for the death penalty and unwilling to consider any mitigating circumstances.  Prosecutors and defense attorneys offered their final arguments to jurors this morning, and District Judge Eric Godderz issued his final instructions to jurors.  Jurors began deliberating just before noon.  Flack was convicted of killing the four near Richter three years ago.
