A Franklin County jury has recommended that Kyle Flack receive the death penalty for killing a mother and her toddler daughter three years near Richter. The jury issued their verdict late this morning in the sentencing phase of Flack’s murder trial.

They ruled that the murder of Kaylee Bailey, who was also raped; and her 18-month-old daughter, Lana Bailey was “especially heinous and vile.” However, that is a recommendation. District Judge Eric Godderz has the final word in sentencing. That is scheduled for May 18, following a pre-sentencing investigation.
If Godderz upholds the death penalty, the sentence would automatically be appealed to the Kansas Supreme court. Flack was convicted last week was convicted of killing the two Baileys, Andrew Stout and Steven White.
