OTTAWA — Attorneys for convicted murderer Kyle Flack have filed a motion for a new trial. In her filing, Flack’s attorney Maban Wright said there were significant errors in the trial to warrant a new trial. Flack’s trial should have been moved out of Franklin County, that she and her co-attorney Tim Frieden weren’t given a full opportunity to remove jurors who appeared too biased for a conviction, and that certain statements by Flack should not have been allowed to be used as evidence, her filing said. A Franklin County jury convicted Flack March 23 of killing Kaylie Bailey and her 18-month-old daughter Lana Leigh Bailey, Andrew Stout and Steven White three years ago at a farmstead near Fichter. Following a sentencing hearing, the jury recommended the death penalty for Flack for the murders of Kaylie and Lana Leigh Bailey. District Judge Eric Godderz will sentence Flack May 18.
