Franklin County Attorney Brandon Jones has been assigned as special prosecutor in the DUI arrest of state senator and former Topeka Municipal Court Judge Vic Miller. Shawnee County District Attorney Mike Kagay says he turned over the case to avoid any appearance of impropriety. Yesterday afternoon Jones filed a one count complaint charging Miller with driving under the influence of alcohol. He asked that a summons be issued for a court date in the future. At this time, a court date has not been set. Jones says this is an allegation that a crime was committed and Miller, as with all individuals charged with a crime, is to be presumed innocent until proven guilty in court.
Topeka Police arrested Miller in May after finding him inside his crashed vehicle in the ditch. Police said he wasn’t injured but appeared intoxicated. County Attorney’s routinely request a special prosecutor in cases that may present a conflict of interest for them or their department.
