An Ottawa man whose Murder Conviction was recently overturned by the Kansas Supreme Court, will be in front of a judge today inFranklin County District Court. County Attorney Brandon Jones, says the first appearance will be routine:
Balbirnie was convicted on murder charges in the death of Paul Nicholson, during a fight in 2011. That conviction was overturned based on his assertion that his attorney at the time, did not provide an adequate defense for him, including not admitting a 911 call into evidence that may have suggested he did not deliver the fatal stab wound.
