The proposed new city of Golden in Miami County, is no more. Petitioners have dropped their appeal of the County Commission’s decision to not approve incorporation. Jennifer Williams, who filed the initial petition to incorporate about nine square miles north of Hillsdale Lake into a city to block the march of intermodal warehouses into Miami County.
Judge Steven Montgomery told them that even if they did win, he couldn’t incorporate the city. All he could do is send it back to the County Commission for reconsideration. Also, he couldn’t get the case to a Bench Trial until October of 2023.
At the hearing last week, County Counselor, Shelly Woodard, told the court that the County Commissioners were not open to mediation. In October of 2021, they voted 3-1 against the incorporation. Before Commissioners issued their decision, they conducted numerous study sessions in the preceding months as they gathered evidence on which to base their decision.
