A man in court for a sentencing hearing, suffered a medical emergency outside the Miami County Courthouse, after the hearing. His wife doesn’t believe it was handled properly and is considering legal action. Forty three-year-old Joshua Ybarra, of Osawatomie appeared in Miami County District Court March 27th for a sentencing hearing, after agreeing to a plea deal. Ybarra was arrested in 2022 and initially charged with one count of aggravated indecent liberties with a child, for allegedly grabbing and running his hands over a 13-year-old victim’s breasts.
His wife says Ybarra takes medication for seizures, and he was clearly having a medical emergency during the sentencing hearing. She says the hearing should have been stopped at that time so Joshua could receive appropriate medical care, but when she called out at the hearing, she was “shushed.” Instead, a 5-minute recess was called, after which the hearing continued. He collapsed after the hearing and was taken to Miami County Medical Center and later to KU Medical Center.
