A Garnett man, found naked in Holy Angels Catholic Church recently, is expected to face charges of disorderly conduct in Anderson County District Court, although there’s no state or local law in town against being naked. Garnett Police Chief Kurt King says officers were called to the church the morning of August 27th after an adult couple discovered 37 year-old Dustin Smith in the church fully nude. Garnett police did not identify Smith since he had not been formally charged as of last week.

The Anderson County Review says they collected his name from county jail booking records. Chief King says the man appeared to be under the influence of a controlled substance and was placed under arrest. He says based on this and a previous incident of an adult female walking around Garnett in the nude, he had asked Garnett City Attorney Terry Solander to draft a chargeable ordinance dealing with public nudity, which could be prosecuted in municipal court. King adds that the state, at the moment does not have a law that addresses this behavior specifically, unless it’s a sexual act. Smith was being held in Anderson County Jail pending a first appearance in district court.
