OTTAWA – Prosecutors have withdrawn their request for a closed evidence hearing in the case of Kyle Flack, who faces murder charges in connection with the killing of four people near Richter last year. The hearing, which will be open to the public, has been rescheduled for March 11. The hearing had originally been scheduled for today. According to court filings, the prosecutors asked to withdraw the request for a secret hearing after reviewing a Kansas Supreme Court ruling which leaned on a Georgia court case. The Georgia case set a four-step test on whether trials or hearings could be closed. Prosecutors also asked to switch the date of the hearing because a key witness couldn’t attend today. More than 800 witnesses could testify in the trial. Flack faces charges of murder, rape and criminal possession of a firearm in connection with the murders of Kaylie Bailey, Lana Leigh Bailey, Andrew Stout, and Steven White.
