OTTAWA — District Judge Eric Godderz sentenced Kyle Flack to death this morning for the murders of Kaylie Bailey and her 18-month-old daughter Lana Leigh Bailey three years ago at a farmstead near Richter.  Flack was sentenced to life for the murders of Andrew Stout and Steven White.  A Franklin County jury convicted Flack two months ago of the murders and recommended that he receive the death penalty.  Godderz accepted the jury’s recommendation, saying the death penalty was supported by the evidence presented during the trial. “No one will ever forget the harm that you have done,” Godderz said. “…If there is any silver lining in all this tragedy it’s that you will never get a chance to do this again.”  Prior to the sentencing, family members of the victims were allowed to testify.  Lisa Smith, mother of Kaylie Bailey and grandmother of Lana Leigh Bailey, said they were beautiful children and “they were taken by a savage murderer. Every step I now take is like walking across cut glass.”  In the meantime, Flack’s attorneys have filed a motion for a new trial, saying there were significant errors in the trial to warrant a retrial.  No hearing has been set for that motion.
