On Thursday, the Kansas Legislative Coordinating Council, or LCC overrode Governor Laura Kelly’s Executive Order that limited Church gatherings and funerals to 10 people or less. Kelly filed suit that afternoon and the Kansas Supreme Court issued an order yesterday setting an expedited schedule to hear oral arguments in the case. The Court is hearing arguments today.
Governor Laura Kelly seeks an order voiding the Legislative Coordinating Council’s decision. That order expressly prohibited more than 10 people from gathering in a confined or enclosed place at the same time, including a Church or other religious facility. The Governor argues no Kansas Statute or other source gives the LCC authority to revoke her Executive Order. She argues the only way to revoke her order is for the Legislature, not the LCC, to act. She also argues the Legislature’s attempt to delegate its authority to the LCC was ineffective and conflicts with the Kansas Constitution. She asks the Kansas Supreme Court to declare that resolution void and stop the LCC from taking future action under the resolution.
