The suspect in Ottawa’s first homicide case in over 10 years will be in Franklin County District Court today for a formal arraignment. Anthony Alvarado will be arraigned on a second degree murder charge in a case that involved a fight with his roommate, 29-year-old Dalton Presley, that led to his death on June 26th of last year at their residence at 11th and Ash. Preliminary hearing was held on May 4th and in that hearing, several witnesses were called to testify, including the lead Ottawa Police Detective, the lead investigator from the Kansas Bureau of Investigation and the first officer on scene from the Franklin County Sheriff’s office, among others. After that hearing, the judge determined that there was enough evidence to hold Alvarado over for a trial.
Defense attorney’s plan to use a self defense claim, saying that Alvarado defended himself when Presley came at him with a gun during a fight in the home. Alvarado is charged with second degree murder. Today’s arraignment will take place at 2:00 in the Franklin County Courthouse.
