It has been 16 months since the Kansas Supreme Court heard an appeal in the Kyle Flack murder case. Flack was found guilty and sentenced to death in May of 2016 of raping and killing 21 year old Kaylie Bailey and her infant daughter, as well as 31 year old Steven White and 30 year old Andre Stout, on a farm on Georgia Road, outside of Ottawa. The appeal stated that a death sentence is prohibited under the Eighth Amendment, because Flack suffers from severe mental illness. Also, the District Court Judge committed a reversible error by admitting Flack’s custodial statements, made after he allegedly invoked his miranda rights. The appeal asked that the court find the State had not carried irts burden beyond a reasonable doubt and the errors were not harmless and they should reverse Flacks convictions and death sentence and demand a new trial. That was nearly a year and a half ago. When can we expect a decision from the Supreme Court? I asked Franklin County Attorney Brandon Jones about the delay:
