Kyle Flack, convicted in 2016 of murdering four people, in rural Franklin County, filed an appeal with the Kansas Supreme Court. They heard the case January 31, 2023. Nearly two years later, the decision from the court has not been released. That appeal focused mainly on two matters. First, insufficient time to review the case for trial and Miranda Rights. In the matter of time for review, Deputy Solicitor General, Kristopher Ailsleger disagreed, saying the District Court gave the defense team extra time on more than one occasion.

KOFO has sent an inquiry to the Kansas Supreme Court about the appeal. As of this time, that inquiry has not been answered. Flack was convicted of capital murder in May of 2016 for killing Kaylie Bailey, her toddler daughter Lana, as well as Steven White and Andrew Stout in May of 2013 on a farm on Georgia Road outside of Ottawa. Lana Bailey’s body was ultimately found in Osage County. Flack was found and arrested in Emporia.
