After agreeing to a plea deal, but suffering a medical emergency after the judge chose not to go by the recommendation of the plea deal and impose a longer sentence, Joshua Uabarra’s attorneys have won a motion to withdraw his plea and go ahead with a jury trial. He is facing a possible life sentence for a charge of one count of aggravated indecent liberties with a child. He was arrested in 2022 and accused of grabbing and running his hands over a 13-year-old victim’s breasts.
Joshua’s wife, Dacia Ybarra, says the incident was captured on video, and she says her husband was intoxicated when he tripped over his feet and reached out and grabbed the victim. Ybarra suffered a seizure after Judge Amy Barth sentenced him to over 11 years in prison after striking a plea deal. Immediately after, his attorney filed to withdraw the plea. It was granted and a pretrial motions hearing is scheduled for 1:15 on August 7, and a three-day jury trial is scheduled to begin at 9:00 on Tuesday, September 24th.
