More information coming out on the Tommy Emerson Meth for Sex Case. The Attorney representing Emerson has asked that the Special Prosecutor in the case be removed because the appointment doesn’t meet Statutory Regulations. Anderson County Attorney Elizabeth Oliver had previously said that if Emerson tried to get the Warrant issued by District Magistrate Kevin Kimball thrown out, she may claim a conflict because she worked frequently with Kimball. Emerson says the Search Warrant for his Garnett home issued by Kimball should be invalid, because he says Kimball had prior knowledge of drug-related activities at Emerson’s home.
The Motion asserts Oliver has still been present throughout most of the case, even with a Special Prosecutor and alleges the County Attorney’s office has apparently been the source of media releases which have pictured Emerson in an unfavorable way. The rescheduled hearing resulted in a new hearing subpoenas being issued for Kimball as well as Garnett Police Officers Todd Turner and Garnett Police Chief Kurt King, for their testimony in the January 19th hearing.
