A motion filed Tuesday in Anderson County District Court in the case of Tommy Emerson, moved for a continuance for the hearing scheduled for yesterday. The reason cited in Court Documents states that the defense attorney has tested positive for COVID 19 and is in the throes of the virus effects. The hearing was supposed to address the issue of a Search Warrant signed by Judge Kevin Kimball on Emerson’s house. Emerson claims Kimball knew him and was aware of the activities going on at his house and the warrant should be thrown out.
Emerson faces 12 Felonies and a misdemeanor, ranging from possession of methamphetamine to distribution with the aid of a telephone device. A Probable Cause Affidavit used to base his charges says he admitted to investigating officers procuring meth and offering it to visitors at his home to intensify their sexual activities.
A new hearing date has not yet been scheduled.
