A hearing scheduled for this morning at 9:00 in Anderson County District Court, will hear arguments from the Defense and Prosecution regarding a Search Warrant executed on Tom Emerson’s house last year. Emerson’s lawyers contend it should be thrown out because the judge signing the warrant knew about the drug and sex activity going on in Emerson’s house. Magistrate Judge Kevin Kimball has denied any relationship with Emerson.
Emerson’s attorney has also called for the removal of a special prosecutor assigned by Anderson County Attorney Elizabeth Oliver, because it does not meet the States Statute for having a Special Prosecutor. Kimball, Garnett Police Chief Kurt King and Investigating Officer Todd Turner have answered subpoenas for the hearing.
