Last month, the Kansas Supreme Court reversed a Wyandotte County District Court decision that had declared the Redistricting Maps drawn by the Kansas Legislature, unconstitutional. Today, the Supreme Court released its full opinion. The majority of the court wrote that partisan gerrymandering claims were not justified under Section 2 of the Constitution and it was not racial gerrymandering, because it did not establish that race was the predominant factor used by the Legislature in their decisions.
Three justices, Biles, Rosen and Standridge say they would have affirmed the District Court decision, but under different rational.
The Court also ruled unanimously that the Legislature followed correct procedure in enacting the maps and they were valid because they did not contain any constitutional errors and complied with the Federal Voting Right Act.
