The family of a Garnett man killed in a fiery crash on I-435 in Kansas City last week, have filed a Wrongful Death Lawsuit. Fifty one year old Joey Schweinfurth of Garnett, died in the crash on July 5th. According to the lawsuit, a man driving a dump truck for his employer, Ballance Contracting Services, lost control of the truck when the left front tire blew, causing the truck to veer off the road, cross the median and travel into oncoming traffic, hitting the side of the Ford F-150 driven by Schweinfurt, killing him. His wife and children are asking for damages due to untimely death and for pain and suffering Schweinfurth experienced between the time he was injured and the time he died.
The suit accuses Ballance Contracting of failing to maintain its dump truck and failing to replace the tires in a timely manner.
The dump truck also hit two other vehicles, causing a five vehicle crash. A passenger in Schweinfurth’s vehicle and another driver were taken to the hospital.
