WICHITA — A Sedgwick County judge has rejected Scott Roeder’s attempt to use what is called a ‘necessity defense’ in his trial for murdering Wichita abortion doctor George Tiller. Roeder, who has publicly confessed to killing Tiller, said he was justified in killing Tiller to save unborn babies. Judge Wilbert Warren said Kansas law doesn’t allow necessity defenses and to allow such defenses in murder cases would basically create legal chaos and anarchy. Roeder who shot Tiller as he stood in his church in Wichita, was arrested along I-35 just outside Franklin County near Gardner.
