A man charged in the death of his one year old son is facing new charges in a different case. Twenty four-year-old Jason Marnell was in court recently for a status hearing on charges of first degree murder and abuse of a child. Prosecutors say he was responsible for the injuries that one month old Waylon Marnell died from. The charges stem from a response to a medical call in Richmond on January 14th, where first responders found an unresponsive infant. He was transported to AdventHealth Ottawa and died two weeks later at Children’s Mercy Hospital.

After the hearing, he was arrested for rape, aggravated indecent liberties with a child and aggravated indecent solicitation of a child. Franklin County Attorney Brandon Jones says the new charges came to their attention shortly after the homicide and were examined by the Kansas Bureau of Investigation. Jones says they got the case back from the KBI last week and immediately filed the new case. He says it is based on allegations from several years back.

A preliminary hearing in Marnell’s murder case is set for October 11th. He is being held in the Franklin County Detention Center.
